Terms of service
Last updated September 13, 2026
These terms govern use of FloBook, provided by FloBook LLC, doing business as FloBook.ai. By creating an account, connecting a service, forwarding a phone line, or using FloBook, you agree to them on behalf of yourself and the business you represent. You confirm that you have authority to bind that business.
What the service is
FloBook is an AI-assisted communications and scheduling service for appointment businesses. Depending on the settings and connections you choose, it may answer and transfer calls, answer questions, identify callers, create or change appointments, read availability, synchronize with third-party calendars or booking systems, send transactional or promotional texts, manage callbacks and waitlists, request deposits through links you provide, request reviews, and present call, client, booking, and performance information. Communications are made in your business's name.
AI limitations and your supervision
FloBook uses automated systems that can mishear, misunderstand, omit information, produce an incorrect response, or fail to complete an action. Any price stated by the assistant is a starting price unless you expressly configure it otherwise and is not a binding quote from FloBook. FloBook is not an emergency service and must not be used for urgent medical, safety, or life-threatening situations. You are responsible for reviewing the service's activity, correcting errors, following up with customers when appropriate, and maintaining another reasonable way for customers to reach your business.
Call recording, AI notices, and consent
You decide whether recording is enabled and which greeting or notice is used. Laws governing recording, transcription, artificial intelligence, automated calls, and consent vary by location and by the locations of the people on a call. You alone are responsible for determining whether a notice or consent is required, selecting and maintaining lawful settings, giving every required notice, obtaining and keeping any required consent, and disabling recording or transcription where it is not lawful. A notice supplied or played by FloBook is a configurable tool, not legal advice or a guarantee of compliance. To the fullest extent permitted by law, FloBook is not responsible for your failure to give a required notice, obtain consent, or lawfully use, download, disclose, or retain a recording or transcript.
Your responsibilities
- Provide complete and accurate services, prices, policies, hours, staff schedules, availability, customer information, and messaging-registration information, and keep it current.
- Secure your account and connected services, give staff only appropriate access, and take responsibility for every action taken through your account or by a person you authorize.
- Obtain all rights and permissions needed for information, documents, websites, calendars, phone numbers, recordings, and customer lists you connect, upload, or use.
- Comply with the TCPA, CAN-SPAM where applicable, carrier rules, recording and wiretap laws, privacy and consumer-protection laws, accessibility obligations, and rules that apply to your industry and customers.
- Send marketing, win-back, review, waitlist, birthday, loyalty, and similar messages only to recipients who may lawfully receive them; honor opt-outs and quiet hours; and ensure that your content, offers, fees, and links are accurate and lawful.
- Resolve your own customer complaints, refunds, appointment disputes, pricing disputes, service quality issues, deposits, no-show fees, and other transactions. FloBook is not a party to the relationship between you and your customers.
- Do not use FloBook for healthcare or other activity involving protected health information, emergencies, unlawful discrimination, deception, harassment, spam, fraud, or other illegal or abusive conduct.
Connected services and customer transactions
Calendar, booking, telephone, messaging, AI, payment-link, email, advertising, and other third-party services remain governed by their own terms and may change, delay, reject, or lose data. You authorize FloBook to exchange information with the services you connect and to take the actions you request through them. You are responsible for checking that bookings, cancellations, messages, transfers, payment requests, and synchronization completed correctly. FloBook does not receive or hold customer card numbers and is not the merchant, payment processor, or escrow agent for transactions between you and your customers.
Acceptable use and enforcement
You may not probe or disrupt the service, bypass access controls, impersonate another person or business, use information without permission, introduce malicious content, resell the service without written permission, or use it in a way that harms FloBook, a provider, or another person. We may restrict or suspend access when reasonably necessary to protect the service or others, investigate suspected misuse, comply with law or provider requirements, or address unpaid amounts. You remain responsible for conduct carried out through your account, including settings and actions chosen by owners, staff, contractors, or agents.
Service availability
We work to keep FloBook available, but do not guarantee uninterrupted, timely, secure, or error-free service. Telephone networks, carriers, calendars, booking systems, payment services, AI providers, internet services, and customer devices can fail or behave unexpectedly. Messages may be filtered or delayed, calls may not connect or transfer, and connected systems may not synchronize. You should maintain reasonable backup procedures and independently verify important appointments and communications.
Fees
FloBook is free during the beta unless we agree otherwise in writing. Beta features may change and may be unavailable or discontinued. After beta, paid service is billed monthly in advance at the rate agreed with you in writing, generally per location. Usage limits or provider pass-through charges, if any, will be disclosed before they apply. You authorize recurring charges using the payment method on file. You can cancel at any time, and paid service continues through the end of the paid period. Fees already paid are not refundable except where required by law. Taxes are your responsibility except taxes based on our income.
Your data
As between you and FloBook, you retain your rights in your business and client data. You grant us the rights needed to host, process, transmit, and use it to provide, secure, maintain, and improve the service for your business. We process personal information under our privacy policy. On cancellation you can export it, and we delete it according to our retention practices and legal obligations. You are responsible for keeping any copy you need before access ends.
Disclaimers
To the fullest extent permitted by law, FloBook is provided "as is" and "as available." FloBook disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranty arising from course of dealing or usage of trade. We do not warrant any booking, message, call, recording, transcript, AI output, integration, customer response, revenue result, legal compliance, or uninterrupted operation. FloBook does not provide legal, tax, medical, or professional advice.
Your responsibility and indemnity
You are responsible for your business, your customers, your account, your staff and agents, your configurations, and your use of any output or action in FloBook. To the fullest extent permitted by law, you will defend, indemnify, and hold harmless FloBook and its officers, employees, contractors, and providers from claims, losses, penalties, damages, judgments, and reasonable legal costs arising from your data, instructions, products or services, customer relationship, account activity, violation of law or third-party rights, or failure to provide a legally required AI or recording notice or obtain legally required consent.
Limitation of liability
To the fullest extent permitted by law, FloBook and its providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits, revenue, goodwill, data, customers, or bookings; the cost of substitute services; customer claims; or failures caused by your conduct or a third-party service, even if advised that such loss was possible. FloBook's total aggregate liability arising out of or relating to the service or these terms will not exceed the greater of $100 or the fees you paid FloBook during the three months before the event giving rise to the claim. These limits apply to all theories of liability and do not limit liability that cannot legally be limited or excluded.
Ending service
You may stop using FloBook and cancel as described above. We may end or suspend service for a material breach, unlawful or harmful use, provider or legal requirement, nonpayment, or a security risk. Terms that by their nature should survive—including payment obligations, ownership, disclaimers, indemnity, and liability limits—continue after service ends.
Changes
We may update these terms; material changes are emailed to account holders before taking effect. Continued use after that constitutes acceptance.
